The Internet Information Service Algorithmic Recommendation Management Provisions (the Provisions) were issued on January 2022 by the Cyberspace Administration of China (CAC) in cooperation with the Ministry of Industry and Information Technology, the Ministry of Public Security, and the State Administration of Market Supervision and Administration. The provisions apply to the use of algorithmic recommendation technology to provide Internet information services within the mainland territory of the People’s Republic of China. Algorithmic recommendation technology in the Provisions refers to the utilisation of algorithmic techniques, including content creation, personalised suggestions, sorting, content retrieval, and decision-making, to deliver content and information to users. The algorithmic recommendation services are required to, among other things, comply with laws and regulations and follow the principles of equity, fairness, openness, and transparency. The Provisions include various requirements for the providers of algorithmic recommendation services, including among others, data security and information protection obligations, revision, evaluation and verification obligations, provisions for content control, as well as protections for workers impacted by algorithms. The Provisions entered into force on 1 March, 2022.
