Policy overview

The Maryland Facial Recognition Law, also known as HB 1202, introduces new obligations for employers using facial recognition technology during job interviews. The law prohibits the creation of a facial template during an applicant's interview without their explicit consent, given by signing a designated waiver. This waiver should contain the applicant's name, interview date, their consent to use facial recognition during the interview, and confirmation that the applicant has read and understood the waiver. The law entered into force on 1 October, 2020.
